Starting Point

The general terms and conditions listed here (hereinafter referred to as GTC) set the framework for the information, products and services offered via www.waybacktoyou.ch.

Contractual Parties

The sole proprietorship Bruno Sonderegger (hereinafter abbreviated to BRSO), named after the business owner and managing director, operates the online store via www.waybacktoyou.ch (hereinafter referred to as Way back to you). The company BRSO concludes contracts via Way back to you with natural persons as well as legal entities (hereinafter referred to as customer or customers).

Scope of Application

The terms and conditions listed here are a prerequisite for the services provided by the company BRSO via Way back to you and set the framework conditions for the conclusion of a contract between the company BRSO and the customer. By completing an order online, the customer confirms that he has read and understood the GTC and that he agrees and accepts them.

Conclusion of Contract

By completing the purchase on Way back to you, the Customer places a binding order for the selected items in the shopping cart. The receipt of the order will be confirmed to the Customer by e-mail. With the receipt of this order confirmation, a binding contract between the sole proprietorship BRSO and the customer is concluded.

Delivery

Delivery of the ordered goods will be made after full payment of the purchase price and any shipping costs at the commercial bank of the company BRSO. No payments on account are offered. The goods will be delivered to the address specified by the customer in the online order. The delivery of the goods is at the expense and risk of the customer. The shipment of the ordered items will be delivered as soon as possible, depending on availability. If there are delays in delivery, the customer will be notified by the company BRSO via e-mail. Currently, articles are delivered only within Switzerland and to Germany. The delivery happens via the Swiss Post or a courier.

Prices

The company BRSO may change the prices listed on Way back to you at any time. The prices listed on Way back to you at the time of the order are valid. The indicated prices are final prices. This means that the Swiss VAT is included in the prices and is shown separately on the invoice. Also shown separately on the invoice are the costs for packaging and shipping. The prices are shown on Way back to you in CHF and must also be transferred by the customer in CHF.

Terms of Payment

As already mentioned under "Delivery", deliveries are not offered on account. The customer undertakes to pay with a payment option shown on Way back to you. Until full payment of the purchase price, the items ordered by the customer remain the property of the company BRSO. In case of doubt about the customer's ability to pay, the contract can be cancelled by BRSO. If the customer fails to pay, pays only partially or is in default, BRSO can also cancel the contract and the ordered items remain in the possession of BRSO. In case of cancellation of the contract, partial payments already delivered will be returned to the customer by the company BRSO. In case of payments by credit card, the customer will be charged his credit card after the completion of the order. In case of payments via PostFinance (via e-finance account or PostFinnace Card) will be debited from the customer's PostFinance account upon completion of the order. Payments via TWINT are also debited after the order has been completed. 

Return Policy

Returns are possible within 7 calendar days after receipt of the item. The return date corresponds to the day of delivery to the Swiss Post or a courier. We ask the customer to keep the parcel receipt. The items must be returned in their original packaging and intact to the following address of BRSO:

The delivery (return) of the goods is at the expense and risk of the customer. However, a prerequisite for exercising the right of return is that the customer has only worn the goods once for a try-on, as in a retail store, and returns the goods complete and undamaged. We will only take back hygiene items (bikinis bottoms, swim shorts, etc.) if the try-on was done with underwear worn underneath. Returned items will only be accepted if they are unworn (excluding a one-time fitting), unused, unwashed and in their original packaging. Returned goods will be inspected by BRSO to ensure that they are intact. The decision as to whether or not the goods can ultimately be returned rests solely with the BRSO company. If BRSO accepts the returned goods, BRSO will refund the value of the goods to the customer. Accepted returned items will be allowed for sale again. In the event that BRSO decides not to accept the returned item, it will be returned to the customer. In this case, the cost of delivery will be borne by the company BRSO.

Exchange

Due to the process, an exchange is only possible in the form of a return with subsequent new order (see under "Right of return"). Following the return, the customer can purchase the new item via the usual ordering process.

Warranty Service

Deficient items must be reported in writing within 7 calendar days after receipt of the delivery at the above address or by e-mail via contact@waybacktoyou.ch. Depending on the manufacturer of some products, there are guarantees that can be claimed. The company BRSO does not guarantee for a natural abrasion of the articles by the ordinary consumption or for worn parts as well as for defects which are to be led back on improper use or on an above-average stress of the product by the customer.

Product Care & Handling

For correct product care & handling, we ask customers to take into account appropriate instructions with the ordered items as well as information on Way back to you. The company BRSO disclaims any liability for damages due to improper product care & handling.

Liability

The company BRSO rejects the liability of indirect or consequential damages that may arise from the use (e.g. surfing with a bikini purchased through Way back to you) of the articles sold online.

No claims for compensation can be made for damage caused by non-delivery, loss of production, loss of use, loss of orders, loss of profits or other indirect damage.

References and links to third-party websites (including framing or embedding) are outside the responsibility of BRSO. Any responsibility for such websites is declined. Access and use of such websites is at the sole risk of Way back to you visitors.

The company BRSO does not guarantee the correctness, accuracy, timeliness, completeness and reliability of the contributions published by various authors on Way back to you (hereinafter referred to as authors).

Possible contributions on sports, nutrition and lifestyle and other topics do not have to be medically or scientifically based and can be derived exclusively from the personal experiences of the authors. The contributions published on Way back to you are not medical advices. The information published on Way back to you (without explicit reference to professional literature) represents personal opinions and personal advices and is for informational purposes only. If the customers as well as the visitors of the Way back to you website experience possible negative consequences based on the adoption or following of personal opinions or advices of the authors, the company BRSO and the authors reject any liability for this.

The company BRSO and the authors are not liable for possible damages of tangible or intangible nature, which may arise from access to or use or non-use of the published information, through misuse of the connection or through technical problems.

The information published and offers made on Way back to you are non-binding. The company BRSO and the authors have the right to modify, complete, remove or temporarily or permanently cease publication of the information and offers published on Way back to you without notice and at any time.

Data Protection

The company BRSO does not disclose any personal data including home address, e-mail address or telephone number to third parties without the express and at any time revocable consent of visitors and customers. Excluded from this are service partners who require the transmission of data for order processing (e.g. the shipping company commissioned with the delivery and the credit institution commissioned with the payment processing). In these cases, however, the scope of the transmitted data is limited to the minimum necessary. BRSO, in cooperation with the hosting providers, tries to protect the used databases as much as possible from foreign interference and misuse. In a case where customer data is lost due to an abusive intervention by a third party, the company BRSO assumes no liability. Customers must be aware that Internet-based data transmissions can have security gaps and the company BRSO cannot guarantee protection of customer data against improper access. Copyrights

The copyrights and all other rights to content, images, photos or other files on the website belong exclusively to the company BRSO or to the specifically named copyright holders. For the reproduction of any elements, the written consent of the copyright holders must be obtained in advance.

The copyrights and all other rights to contents, which are shown via references and links on websites of third parties (including framing or embedding) on Way back to you, do not belong to the company BRSO.

Changes to the GTC

The GTC listed here can be changed at any time without prior notice. The most recent GTC will be published on Way back to you.

Applicable Law

Swiss law is the sole applicable law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

Place of Jurisdiction

The place of jurisdiction is Bellinzona. However, the sole proprietorship BRSO may also sue the customer in the courts of its domicile or in any other competent court.
